2. Applicability

These terms and conditions apply to every offer from Rokersbenodigdheden and to every distance contract concluded via rokersbenodigdheden.com.

By placing an order, you agree to these terms.

3. Age limit

Our products are sold exclusively to people aged 18 and over. By placing an order, you declare that you are 18 or older.

We ask for valid ID when you collect an order in store and may ask for it on delivery. We reserve the right to refuse or cancel an order if there is reasonable doubt about the customer's age.

Additional statutory age or sales restrictions may apply to orders to other EU countries. We apply these insofar as they apply to our sales.

4. Offer and contract

All offers are valid while stocks last. The contract is concluded when we confirm your order by email.

Obvious mistakes or errors in the offer are not binding on us.

Images are intended to show the products as accurately as possible. Small differences in colour may arise, for example, from screen settings. This does not affect your statutory rights if a delivered product does not conform to the contract.

5. Prices and payment

All prices are in euros and include VAT. Shipping costs are calculated separately and shown before you complete your order.

Payment is made using the payment methods offered on the website. We start processing your order once payment has been received.

6. Delivery and collection

We ship within the Netherlands and to the EU countries offered as available shipping destinations at checkout at the time of ordering. The available shipping methods, shipping costs and any conditions are shown at checkout before you complete your order.

You can also collect your order free of charge from one of our shops in Nijmegen when this option is available at checkout. You will be notified as soon as your order is ready.

We deliver within the agreed period. If no delivery time has been agreed, we deliver within 30 days at the latest.

If delivery is late, your statutory rights apply. Where the law requires it, you must first give us a reasonable additional period to deliver.

The risk of damage or loss passes to the customer when the order has been received by the customer, or by a third party designated by the customer who is not the carrier.

For collection in store, the risk passes when the order is received by you or by the person you have designated.

7. Right of withdrawal and returns

Our Return and Refund Policy applies to consumer orders, including the statutory 14-day right of withdrawal for distance contracts and the legally permitted exceptions to it.

Our Return and Refund Policy forms an integral part of these terms.

Online orders collected from one of our shops are also covered by the right of withdrawal for distance contracts if the contract was concluded online.

In addition to the statutory right of withdrawal, we offer the additional return guarantee described in our Return and Refund Policy. This additional guarantee does not limit your statutory rights.

8. Conformity and warranty

We guarantee that the products delivered conform to the contract and to the statutory requirements.

If a product does not conform to the contract, you have the statutory rights that apply to consumers, including, where applicable, free repair or replacement and, where the statutory conditions are met, a price reduction or termination of the contract.

Any manufacturer's or commercial warranty applies in addition to your statutory rights and does not affect them.

9. Liability

We are liable for damage insofar as it can be attributed to us under the law.

Nothing in these terms limits or excludes liability insofar as this is not permitted under mandatory law.

Products must be used in accordance with their intended purpose and any instructions for use and safety.

10. Personal data

We process personal data in accordance with our Privacy Policy and applicable privacy legislation, including the General Data Protection Regulation (GDPR).

11. Complaints and applicable law

If you have a complaint about a product, an order or our service, you can contact us via service@rokersbenodigdheden.com.

We handle complaints as quickly as possible and respond within 14 days of receipt at the latest. If a complaint needs more time, we will let you know.

Contracts with Rokersbenodigdheden are governed by Dutch law. If you are a consumer living in another country, you keep the protection of mandatory consumer law provisions that apply to you under the applicable law.

12. Changes

We may change these terms and conditions from time to time.

An order is always subject to the terms and conditions in force at the time the contract was concluded.

Changes to these terms do not apply retroactively to contracts already concluded, unless permitted or required by law.
